  4. THIS IS A LEGAL AGREEMENT TO WHICH YOU ARE CONSENTING TO BE BOUND. IF YOU
  5. DO NOT AGREE TO ALL OF THE TERMS OF THIS LICENSE, DO NOT USE THE SOFTWARE.

  7. 1.  Netscape Communications Corporation ("MCom") grants to you a non-exclusive,
  8. non-sublicensable, license to use this Beta version of the Netscape network
  9. navigator (the "Software"), in binary executable form for evaluation and trial
  10. use purposes only.

  12. 2.  MCOM MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF THIS SOFTWARE
  13. OR ABOUT ANY CONTENT OR INFORMATION MADE ACCESSIBLE BY THE SOFTWARE,
  14. FOR ANY PURPOSE. THE SOFTWARE IS PROVIDED 'AS IS' WITHOUT EXPRESS OR
  15. IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND
  16. FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. THIS SOFTWARE IS
  17. PROVIDED GRATUITOUSLY AND, ACCORDINGLY, MCOM SHALL NOT BE LIABLE UNDER
  18. ANY THEORY OR ANY DAMAGES SUFFERED BY YOU OR ANY USER OF THE SOFTWARE.
  19. MCOM WILL NOT SUPPORT THIS SOFTWARE AND WILL NOT ISSUE UPDATES TO THIS
  20. SOFTWARE.

  22. 3.  All content accessed through the Software is the property of the applicable
  23. content owner and may be protected by applicable copyright law. This License
  24. gives you no rights to such content.

  26. 4. While MCom intends to distribute a commercial release of the Software, MCom
  27. reserves the right at any time not to release a commercial release of the
  28. Software or, if released, to alter prices, features, specifications,
  29. capabilities, functions, licensing terms, release dates, general availability or
  30. other characteristics of the commercial release.

  32. 5.  Title, ownership rights, and intellectual property rights in and to the
  33. Software shall remain in MCom and/or its suppliers. You agree to abide by the
  34. copyright law and all other applicable laws of the United States including, but
  35. not limited to, export control laws. You acknowledge that the Software in source
  36. code form remains a confidential trade secret of MCom and/or its suppliers and
  37. therefore you agree not to modify the Software or attempt to decipher,
  38. decompile, disassemble or reverse engineer the Software, except to the extent
  39. applicable laws specifically prohibit such restriction.

  41. 6.  MCom may terminate this License at any time by delivering notice to you and
  42. you may terminate this License at any time by destroying or erasing your copy of
  43. the Software.  Upon termination of this License, or in any event within thirty
  44. (30) days following MCom's release of a commercial version of the Software, you
  45. agree to destroy or erase the Software.  In the event of termination, the
  46. following sections of this License will survive: 2, 3, 4, 5, 6, 7 and 8.  This
  47. License is personal to you and you agree not to assign your rights herein.  This
  48. License shall be governed by and construed in accordance with the laws of the
  49. State of California and, as to matters affecting copyrights, trademarks and
  50. patents, by U.S. federal law. This License sets forth the entire agreement
  51. between you and MCom.

  53. 7.  Use, duplication or disclosure by the Government is subject to
  54. restrictions set forth in subparagraphs (a) through (d) of the Commercial
  55. Computer-Restricted Rights clause at FAR 52.227-19 when applicable, or in
  56. subparagraph (c) (1) (ii) of the Rights in Technical Data and Computer
  57. Software clause at DFARS 252.227-7013, and in similar clauses in the NASA
  58. AR Supplement. Contractor/manufacturer is Netscape Communications Corporation,
  59. 650 Castro Street, Suite 500, Mountain View, CA 94041.

  61. 8. You may not download or otherwise export or reexport the Software or 
  62. any underlying information or technology except in full compliance 
  63. with all United States and other applicable laws and regulations.  In 
  64. particular, but without limitation, none of the Software or underlying 
  65. information or technology may be downloaded or otherwise exported or 
  66. reexported (i) into (or to a national or resident of) Cuba, Haiti, 
  67. Iraq, Libya, Yugoslavia, North Korea, Iran, or Syria or (ii) to anyone 
  68. on the US Treasury Department's list of Specially Designated Nationals 
  69. or the US Commerce Department's Table of Deny Orders.  By downloading 
  70. the Software, you are agreeing to the foregoing and you are 
  71. representing and warranting that you are not located in, under 
  72. control of, or a national or resident of any such country or on any 
  73. such list.
